(General Terms and Conditions for the Caffeiny Online Shop)

1. Scope and Provider
These General Terms and Conditions (“T&Cs”) apply to all orders placed by consumers and businesses via the online shop at [www.caffeiny.com], operated by:

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession (Section 1 KSchG). A business is a natural or legal person or partnership acting in the course of a commercial or self-employed professional activity.
2. Contract Formation
The product listings in our online shop are non-binding offers. By placing an order, you submit a binding offer to purchase. The contract is formed when we send an order confirmation via email or upon delivery of the goods.Orders are only accepted from customers who are 18 years or older.
3. Prices and Payment
All prices are stated in Euros (€) and include statutory VAT, where applicable. Shipping costs are calculated separately and displayed during checkout.
We accept the following payment methods:
- Credit/debit cards (processed via Stripe)
- Any additional methods as displayed during checkout
Payment is due immediately upon order placement. Your account will be charged at the time of order confirmation.
4. Shipping and Delivery
We ship within Austria and internationally. Available countries for shipment are indicated in the checkout. Delivery times and costs are indicated at checkout. Estimated delivery times are non-binding unless expressly agreed upon.
If an item is unavailable, we will inform you and may cancel the contract.
5. Right of Withdrawal (Consumers Only)
Consumers have a 14-day right of withdrawal in accordance with Austrian and EU law.
Withdrawal Instructions
You may withdraw from the contract within 14 days without giving any reason. The withdrawal period begins on the day you or a third party (other than the carrier) takes possession of the goods.
To exercise your right of withdrawal, you must inform us via email at office@caffeiny.com with a clear statement of your decision.
You may (but are not required to) use the following model:

Effects of Withdrawal
If you withdraw, we will refund all payments received from you, including shipping costs (except for extra costs due to your choice of a non-standard shipping method), within 14 days of receiving your notice. Refunds will be made using the original payment method.
We may withhold the refund until we receive the goods or evidence of their return.
You must return the goods without undue delay, no later than 14 days from the day you notify us of your withdrawal. You bear the direct cost of return shipping.
6. Retention of Title
Goods remain our property until full payment has been received.
7. Warranty and Liability
The statutory warranty provisions under Austrian law apply.
We are liable for intent and gross negligence. For other damages caused by slight negligence, we are only liable for breaches of essential contractual obligations, and only to the extent foreseeable at the time of contract.
We are not liable for indirect damages or lost profits.
8. Account Registration
You may create a customer account. You are responsible for maintaining confidentiality of your login details and for all activities under your account.
9. Data Protection
We process personal data only as necessary for fulfilling our contractual obligations and in accordance with applicable data protection laws. For details, see our Privacy Policy.
10. Governing Law and Jurisdiction
These T&Cs and all contracts are governed by the laws of Austria, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
For consumers, the mandatory consumer protection provisions of their country of residence remain unaffected.
If the customer is a business, the place of jurisdiction shall be the competent court in Vienna, Austria.
11. Final Provisions
If any provision of these T&Cs is invalid, the remainder shall remain unaffected.We reserve the right to update these terms at any time. The version in effect at the time of order shall apply.
